This course is particularly suitable for staff working with young people aged 16 and 17, but will also be of use to those working with younger people and their families to prepare them for the transition into adulthood and the implications of the Mental Capacity Act 2005 (MCA).

This course will enable staff who work with children and young people about how the Mental Capacity Act impacts on 16- and 17-year-olds. It will also look at the requirements for authorising care arrangements which amount to a deprivation of a person’s liberty, for all children and young people under 18 years.

Aims:

  • To reinforce the principles of the MCA and how they impact on 16- and 17-year olds
  • To be familiar with the relationship between consent, best interests and parental responsibility for young people who have difficulty making decisions
  • To consider the concept of restraint in the MCA context and when it becomes a deprivation of liberty
  • To understand the different routes to authorise care which amounts to a deprivation of liberty for children and young people.
